LARQ Hydration Club: Terms & Conditions

Welcome to the LARQ Hydration Club! We’re excited to reward you for being a loyal LARQ customer. Please read these Terms & Conditions (“Terms”) carefully. By participating in the LARQ Hydration Club (“Program”), you agree to be bound by these Terms, as well as the LARQ Website Terms of Use and LARQ Privacy Policy, both of which are incorporated herein by reference.

1. Program Overview & Eligibility

1.1. Program Name: The LARQ Hydration Club is a loyalty program offered by LARQ, Inc. (“LARQ,” “we,” “us,” or “our”).

1.2. Program Start Date: The LARQ Hydration Club officially launches on August 18, 2025. Points will only accrue for purchases made on or after this date.

1.3. Eligibility:

  • The Program is open to legal residents of the United States, Canada, the United Kingdom, Australia, Austria, Belgium, Bulgaria, Canada, Croatia, Czechia, Denmark, Estonia, Finland, France, Germany, Greece, Hong Kong, Hungary, Iceland, Ireland, Italy, Japan, South Korea, Latvia, Lithuania, Luxembourg, Netherlands, New Zealand, Norway, Poland, Portugal, Romania, Singapore, Slovakia, Slovenia, Spain, Sweden, Switzerland, Taiwan, Thailand, who are 18 years of age or older (or the age of majority in their jurisdiction of residence).
  • Membership is free and requires an active customer account on www.livelarq.com.
  • Only one (1) account per individual is permitted. Corporations, businesses, resellers, and other entities are not eligible to participate.
  • Employees of LARQ and its affiliates are eligible to participate, but certain restrictions may apply (e.g., cannot combine with employee discounts).

1.4. Acceptance of Terms: By joining or participating in the LARQ Hydration Club, you acknowledge that you have read, understood, and agree to these Terms and any future amendments, as well as our Privacy Policy and Website Terms of Use. Your participation in the Program may involve the collection and use of certain personal information as detailed in our Privacy Policy. This may include purchase history, preferences, and communication opt-ins.

2. Earning Points

2.1. Earning Rate: As a member of the LARQ Hydration Club, you will earn one (1) point for every one ($1) U.S. dollar spent on eligible purchases at www.livelarq.com.

2.2. Eligible Purchases: Points are earned on the net purchase amount of physical products (after any discounts or promotions, and excluding shipping fees, taxes, and gift card purchases). For example, if you purchase a LARQ Bottle PureVis™ for $99.00 and apply a $10 discount, you will earn points on $89.

2.3. Exclusions: Points are NOT earned on:

  • The purchase of LARQ Gift Cards or Store Credit
  • Shipping fees
  • Sales tax or other applicable taxes
  • Returns, refunds, or canceled orders,
  • Purchases made prior to joining the Program
  • Purchases made through third-party retailers or platforms
  • Any charitable donations or similar contributions.

2.4. Point Accrual: Points will typically be credited to your account after your order has shipped and passed any applicable return period (if specified by LARQ). Points for returned items will be deducted from your balance.

2.5. Bonus Point Promotions: LARQ may, from time to time, offer special promotions where you can earn bonus points (e.g., double points, points for specific actions like reviews or referrals). These promotions may be subject to their own specific terms and conditions, which will be published at the time of the promotion.

3. Redeeming Points

3.1. Redemption Value: Points can be redeemed for discounts on future eligible purchases at www.livelarq.com. Every one thousand (1,000) points can be redeemed for a ten ($10) U.S. dollar value discount.

3.2. Redemption Increments: Points can be redeemed for discounts of $10, $20 or $35.

$10 = 1,000 points
$20 = 2,000 points
$35 = 3,500 points

Discount values may be subject to change following an exchange rate of 100 points = $1

3.3. How to Redeem:

  • Log in to your LARQ account on www.livelarq.com.
  • During the checkout process, you will have the option to apply available points to your order.
  • Select the desired redemption amount in $10 increments (e.g., $10, $20, $35, etc.).

3.4. Redemption Exclusions:

  • Points cannot be redeemed for cash, gift cards, or credit.
  • Points cannot be redeemed for filter subscription plan renewals.
  • Points cannot be applied to past purchases.
  • Points cannot be used to pay for shipping fees or taxes unless otherwise specified.
  • Points redemptions may not be combinable with other discounts, promotions, or offers, as determined by LARQ in its sole discretion. This includes products with a discount from subscription (e.g., replacement filters).

3.5. Returns & Exchanges with Redeemed Points:

  • If you return an item for which points were redeemed, the points used for that purchase will be credited back to your Hydration Club account.
  • If you return an item for which you earned points, those points will be deducted from your account balance. If your balance becomes negative, future points earned will be applied to cover the negative balance.

3.6. Currency Display and Conversion:

All points earned and redeemed through the LARQ Hydration Club are calculated based on U.S. dollar (USD) values. For members located outside the United States, LARQ may display an approximate local currency equivalent (e.g., CAD) for convenience. However, the actual earning and redemption of points will be governed by the USD value, and any currency conversions are for display purposes only and subject to change based on exchange rates at LARQ’s discretion.

3.7. No Property Rights in Points:

Points are promotional in nature and do not constitute property. They have no cash value, are not transferrable or inheritable, and cannot be redeemed for cash. Points may be revoked at any time as provided in these Terms.

4. Membership Tiers

4.1. The LARQ Hydration Club currently features two (2) membership tiers: Hydration Rookie and Hydration Guru. Eligibility for each tier is based on the cumulative amount spent on eligible purchases at www.livelarq.com within a consecutive 12-month period.

  1. Tier Qualification Period: Tier status is determined by your eligible net spend over the immediately preceding 12-month period. Your tier status will be updated daily based on this rolling period. Your 12-month period in a new tier will begin the date you’ve satisfied the eligibility requirements.
  • Tier Maintenance: To maintain your tier status, you must continue to meet the qualifying spend threshold within each subsequent 12-month period or be subscribed to a filter plan. If your spend falls below the required threshold and you are not subscribed to a filter plan, you may be downgraded to a lower tier.
  • Tier Benefits Summary:

A. Hydration Rookie

  • Qualification: All members begin as Hydration Rookies upon joining the Program. Members remain Hydration Rookies until their cumulative eligible spend reaches the Hydration Guru threshold.
  • Earning Rate: Hydration Rookies earn 3 points for every one $1 U.S. dollar spent on eligible purchases at www.livelarq.com.
  • Redemption Rate: Points are redeemable at a rate of 1,000 points for $10 off.

B. Hydration Guru

  • Qualification: Members qualify for Hydration Guru status by meeting at least one of the following criteria within the qualifying period:
    • Active Subscription: Having at least one active LARQ subscription.
    • Cumulative Spend within 12-month period: Achieving a cumulative eligible spend of $500 USD or more at www.livelarq.com. Once qualified, members will maintain their Hydration Guru status as long as they continue to meet at least one of these criteria. For example, if you have an active subscription and your cumulative spend is above $500, and you later cancel your subscription, you will remain a Hydration Guru if your cumulative spend is still $500 or more.
    • Downgrade Policy: If you no longer meet either of the Hydration Guru qualification criteria (i.e., you do not have an active filter subscription and your 12-month cumulative eligible spend falls below $500), your tier status will be downgraded to Hydration Rookie at the next review period.
  • Points Upon Downgrade: When downgraded, your existing point balance remains unaffected. Your points and earning rules will change to reflect the Hydration Rookie rate (e.g., back to 3 point per $1 spent).
  • Earning Rate: Hydration Gurus earn 5 points for every one ($1) U.S. dollar spent on eligible purchases at www.livelarq.com.
  • Additional Points For Actions  (one-time):
    • Create an account: +250 points
    • Subscribe to email: +250 points
    • Subscribe to SMS: +250 points
    • Follow LARQ on socials:
      • Instagram: +150 points
      • TikTok: +150 points
      • X: +150 points
      • Facebook: +150 points
    • First purchase bonus: +500 points
    • Recurring filter renewal: 5 points per $1 spent on every automatic refill
    • Write a review: +250 points per unique purchased product review
  • Redemption Rate: Points are redeemable at a rate of 1000 points for $10 off (i.e., a slightly better redemption value).
  • Additional Benefits (Examples):
    • Early access to sales and promotions
    • Exclusive access to LARQ surveys
    • Exclusive Hydration Guru-only gifts with purchase (Subject to availability. While supplies last).

LARQ’s Right to Modify Tiers: LARQ reserves the right, in its sole discretion, to modify, add, or remove membership tiers, change tier qualification criteria, change earning rates, change redemption rates, or alter any benefits associated with any tier at any time, with or without notice. Any such changes will be reflected in these Terms.

5. Account Management

5.1. Checking Point Balance: You can view your current point balance by logging into your account on www.livelarq.com and navigating to your Hydration Club dashboard.

5.2. Fraud & Abuse: LARQ reserves the right to monitor all Program activity. Suspected fraud, abuse, or violations of these Terms may result in point forfeiture, tier downgrade, or account termination.

5.3. Updating Information: It is your responsibility to keep your contact information (including email address) accurate and up-to-date in your LARQ account. LARQ is not responsible for lost communications or benefits due to incorrect or outdated information.

5.4. Account Security: You are responsible for maintaining the confidentiality of your LARQ account password and for restricting access to your account. You agree to accept responsibility for all activities that occur under your account. Notify LARQ immediately of any unauthorized use of your account. Points and benefits are non-transferable and may only be used by the account holder to whom they were issued.

6. Expiration of Points & Account Inactivity

6.1. Point Expiration: Points earned in the LARQ Hydration Club will expire if there is no earning or redeeming activity on your account for a continuous period of twelve (12) months. We will endeavor to send you a reminder email prior to points expiring, but it is ultimately your responsibility to track your points.

6.2. Member-Initiated Termination: You may cancel your participation in the Program at any time by contacting Customer Service. Upon cancellation, all points and tier status will be forfeited and cannot be reinstated.

6.3 Account Termination for Inactivity: LARQ reserves the right to terminate or deactivate accounts that show no activity (no earning or redeeming of points) for a continuous period of twenty-four (24) months. Upon termination, all accumulated points will be forfeited and cannot be reinstated.

7. Program Modification & Termination

7.1. Right to Modify or Terminate: LARQ reserves the right, in its sole discretion, to modify, suspend, or terminate the LARQ Hydration Club, or any portion thereof, at any time, with or without notice. This includes, but is not limited to, changing the point earning rate, point redemption value, eligible purchases, exclusions, or point expiration policies.

7.2. Impact on Points: In the event of program termination, LARQ will provide reasonable notice (e.g., 30 days) to allow members to redeem their accrued points. If points are not redeemed within the specified period, they will be forfeited.

7.3. Notice of Changes: Any changes to these Terms will be posted on this page with a revised “Last Updated” date. Your continued participation in the Program after the posting of any changes constitutes your acceptance of such changes.

8. Disclaimers & Limitations of Liability

8.1. No Guarantees: LARQ makes no guarantee, representation, or warranty, express or implied, regarding the Hydration Club. The Program is provided on an “as is” and “as available” basis. LARQ does not warrant that the Program will be uninterrupted, error-free, or secure.

8.2. Limitation of Liability: TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LARQ AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS (COLLECTIVELY, THE “LARQ PARTIES”) SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF THE LARQ PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO, USE OF, OR INABILITY TO USE THE LARQ HYDRATION CLUB.

8.3. Errors: LARQ is not responsible for any typographical errors, technical issues, or errors in communications related to the Program. LARQ reserves the right to correct any errors in point balances or redemption values.

8.4. Limitation of Total Liability:

To the fullest extent permitted by applicable law, LARQ’s total cumulative liability for any claims arising out of or relating to the Program shall not exceed the total value of points earned by the member in the twelve (12) months preceding the event giving rise to the claim.

9. Governing Law & Dispute Resolution

9.1. Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles.

9.2. Dispute Resolution – Binding Arbitration:

  • Initial Resolution: Most concerns can be resolved quickly by contacting LARQ Customer Service at hello@livelarq.com.
  • Agreement to Arbitrate: EXCEPT FOR DISPUTES THAT QUALIFY FOR SMALL CLAIMS COURT, ALL DISPUTES ARISING OUT OF OR RELATED TO THESE TERMS OR THE LARQ HYDRATION CLUB (INCLUDING ANY ALLEGED BREACH THEREOF), WHETHER BASED IN CONTRACT, TORT, STATUTE, FRAUD, MISREPRESENTATION, OR ANY OTHER LEGAL THEORY, SHALL BE RESOLVED THROUGH FINAL AND BINDING ARBITRATION BEFORE A SINGLE ARBITRATOR. THE ARBITRATION WILL BE ADMINISTERED BY JAMS IN ACCORDANCE WITH ITS APPLICABLE ARBITRATION RULES. JUDGMENT ON THE AWARD RENDERED BY THE ARBITRATOR MAY BE ENTERED IN ANY COURT HAVING JURISDICTION THEREOF.
  • Waiver of Class Action: YOU AGREE THAT YOU MAY BRING CLAIMS AGAINST LARQ ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. UNLESS BOTH YOU AND LARQ AGREE OTHERWISE, THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS, AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR CLASS PROCEEDING.
  • Arbitration Location: The arbitration shall be held in San Mateo, California, or at another mutually agreed-upon location.
  • Arbitration Costs: Each party will be responsible for their own costs and fees, including attorneys’ fees, during the arbitration process.

10. Miscellaneous

10.1. Severability: If any provision of these Terms is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.

10.2. Entire Agreement: These Terms, together with the LARQ Website Terms of Use and Privacy Policy, constitute the entire agreement between you and LARQ regarding the LARQ Hydration Club.

10.3. Waiver: No waiver of any provision of these Terms by LARQ shall be deemed a further or continuing waiver of such provision or any other provision.

10.4. Assignment: You may not assign your rights or obligations under these Terms. LARQ may assign its rights and obligations under these Terms.

10.5. Force Majeure: LARQ shall not be liable for any failure or delay in performing its obligations under these Terms if such failure or delay is caused by circumstances beyond its reasonable control, including, without limitation, acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials. LARQ reserves the right to monitor all Program activity. Suspected fraud, abuse, or violations of these Terms may result in point forfeiture, tier downgrade, or account termination.
